Crystal Crescent Beach
Nova Scotia, Canada
Crystal Crescent Beach is a group of three beaches near Halifax, Nova Scotia. The third beach is clothing optional. It has become popular among local gay men and is used mainly by males.
In 2001, the Royal Canadian Mounted Police arrested five people at the beach for "public indecency." The Canadian criminal code defines public indecency as "committing an indecent act in a public place ... with intent to insult or offend." Prosecutors refused to prosecute the case, saying that merely being nude at an isolated nude beach, without committing a lewd act, was not indecent. The result: it's now officially OK to be nude at the beach.
Very few people go swimming there because the water is cold almost year-round.

The beach itself is warm in the summer. Above is artist Fabien Lutz-Barabé (at right) and a friend. I call this photo "thick and thin."

All I could say about swimming there: Major shrinkage!
The beach looks nice, but the cold water is a no-go.
There was a similar problem in Québec for the nudist beach at OKA near Montréal. Went to court.
The gist of it: the jurisdiction of the laws/bylaws that require clothing does not expend to water bodies. And the extent of water bodies is defined by their normal highest level (aka: spring flood).
Therefore, the beach which is present in summer is defined as being part of the lake and the rules on chlothing do not appy on the beach or in the lake. But they do apply in the forest behind beach.
The OKA beach is part of provincial park and the park security does patrol the beach to fine those performing lewd acts. They want to keep it clean for families etc. But not sure on jurisdiction.
